关于促进民营经济发展壮大的实施意见
为深入贯彻习近平总书记关于民(min)营经济(ji)(ji)发(fa)展(zhan)的(de)重要论述(shu),进一步优(you)化民(min)营经济(ji)(ji)发(fa)展(zhan)环境,促进民(min)营经济(ji)(ji)做大(da)做优(you)做强,根据《中(zhong)共(gong)中(zhong)央 国务院关于促进民(min)营经济(ji)(ji)发(fa)展(zhan)壮大(da)的(de)意见》精神,结合我省实(shi)际,提出如下实(shi)施意见。
一、持续优化民营经济(ji)发展环境(jing)
(一(yi))持续破除市(shi)场(chang)(chang)准(zhun)入壁(bi)垒(lei)。严格落实市(shi)场(chang)(chang)准(zhun)入负面清(qing)单(dan)制(zhi)度,推动各类经(jing)营主体依(yi)法平等进入清(qing)单(dan)之(zhi)外的行(xing)(xing)业、领域、业务。建立涉企行(xing)(xing)政许可相关中介服(fu)务事项清(qing)单(dan)管(guan)理(li)制(zhi)度,未纳入清(qing)单(dan)事项一(yi)律不再作为行(xing)(xing)政审批的受理(li)条件。建立市(shi)场(chang)(chang)准(zhun)入壁(bi)垒(lei)投诉(su)和处理(li)回应机制(zhi),稳(wen)步开展市(shi)场(chang)(chang)准(zhun)入效(xiao)能评估。
(二)全(quan)面(mian)落(luo)实公(gong)平(ping)(ping)竞争政策制(zhi)度。严格落(luo)实国家市场干预行为负(fu)面(mian)清(qing)单(dan),及时清(qing)理废除(chu)含有地方保护、市场分割、指定交(jiao)易等(deng)妨(fang)碍统一市场和公(gong)平(ping)(ping)竞争的(de)政策。未经公(gong)平(ping)(ping)竞争不(bu)得授予(yu)经营者特许(xu)经营权。畅(chang)通公(gong)平(ping)(ping)竞争审查举(ju)报(bao)投诉渠(qu)道。强(qiang)化制(zhi)止滥(lan)用行政权力(li)排(pai)除(chu)限制(zhi)竞争的(de)反(fan)垄断(duan)执法(fa)。
(三)完善社会(hui)信(xin)用(yong)(yong)激(ji)(ji)励约(yue)束机制(zhi)。健全(quan)完善全(quan)省一体(ti)化信(xin)用(yong)(yong)信(xin)息共享(xiang)平(ping)台体(ti)系,推行信(xin)用(yong)(yong)承诺和信(xin)用(yong)(yong)评(ping)价(jia)制(zhi)度(du)。发挥信(xin)用(yong)(yong)激(ji)(ji)励机制(zhi)作(zuo)用(yong)(yong),在市场(chang)监管领域减少对信(xin)用(yong)(yong)等级较高(gao)企业的(de)(de)抽查检查频次。健全(quan)失(shi)信(xin)行为纠正(zheng)后的(de)(de)信(xin)用(yong)(yong)修(xiu)复机制(zhi)。建(jian)立(li)健全(quan)政务失(shi)信(xin)记录和惩戒制(zhi)度(du)。
(四)完(wan)善市场(chang)化(hua)(hua)重整机制。鼓(gu)(gu)励民(min)营(ying)企业(ye)盘活存量资产(chan)回收(shou)资金(jin)。全面落(luo)实(shi)简易(yi)注销、普(pu)通注销制度。完(wan)善破(po)产(chan)制度配套政(zheng)策,建立健全企业(ye)破(po)产(chan)常态化(hua)(hua)府(fu)院(yuan)联动协调机制。落(luo)实(shi)市场(chang)经营(ying)主体(ti)歇业(ye)制度。优化(hua)(hua)个体(ti)工商户(hu)转企业(ye)相关(guan)政(zheng)策。鼓(gu)(gu)励引导行业(ye)协会商会围(wei)绕产(chan)业(ye)链(lian)(lian)创新链(lian)(lian)搭(da)建交流平台,促进资源共享、项目合作。
(五(wu))打(da)造一流营(ying)(ying)商(shang)环(huan)境(jing)。深化(hua)营(ying)(ying)商(shang)环(huan)境(jing)综合配套改(gai)革,构建(jian)企业(ye)全生命周(zhou)期要素保障和权益保护机制,推(tui)动(dong)全省营(ying)(ying)商(shang)环(huan)境(jing)建(jian)设水平进入全国一流行(xing)列。推(tui)进“一件(jian)事(shi)一次办”改(gai)革,深化(hua)“一网通办”改(gai)革。全面推(tui)行(xing)证明事(shi)项告知承诺(nuo)制,打(da)造“无证明畅行(xing)中(zhong)原”品牌。完(wan)善营(ying)(ying)商(shang)环(huan)境(jing)投诉(su)举报平台、12345政务服务便民热(re)线(xian)等功能,畅通民营(ying)(ying)企业(ye)诉(su)求(qiu)反映渠道。
二、加大对民营经(jing)济政策支(zhi)持力度(du)
(六)完善融(rong)(rong)(rong)(rong)资(zi)(zi)支持(chi)政(zheng)策制度(du)。银(yin)行(xing)(xing)业(ye)金(jin)(jin)融(rong)(rong)(rong)(rong)机构要提(ti)高服(fu)(fu)(fu)务(wu)民(min)(min)营(ying)企(qi)(qi)(qi)业(ye)相关业(ye)务(wu)在绩效考核(he)中的权重(zhong),加(jia)(jia)大对(dui)(dui)民(min)(min)营(ying)企(qi)(qi)(qi)业(ye)的金(jin)(jin)融(rong)(rong)(rong)(rong)支持(chi)力(li)度(du)。加(jia)(jia)强涉企(qi)(qi)(qi)信(xin)(xin)(xin)用信(xin)(xin)(xin)息收(shou)集,引(yin)导商业(ye)银(yin)行(xing)(xing)接入“信(xin)(xin)(xin)易(yi)贷(dai)(dai)”等融(rong)(rong)(rong)(rong)资(zi)(zi)信(xin)(xin)(xin)用服(fu)(fu)(fu)务(wu)平台,扩大民(min)(min)营(ying)企(qi)(qi)(qi)业(ye)信(xin)(xin)(xin)用贷(dai)(dai)款(kuan)规(gui)模。鼓励(li)(li)银(yin)行(xing)(xing)对(dui)(dui)生产(chan)经营(ying)正常、暂时遇到困难的企(qi)(qi)(qi)业(ye)贷(dai)(dai)款(kuan)按市(shi)(shi)场(chang)化(hua)原(yuan)则(ze)提(ti)供接续融(rong)(rong)(rong)(rong)资(zi)(zi)服(fu)(fu)(fu)务(wu),不盲目抽(chou)贷(dai)(dai)、压贷(dai)(dai)、断贷(dai)(dai)。鼓励(li)(li)搭建商会(hui)(hui)融(rong)(rong)(rong)(rong)资(zi)(zi)助贷(dai)(dai)载体,在全省(sheng)商会(hui)(hui)推(tui)(tui)广“银(yin)行(xing)(xing)+商会(hui)(hui)+担保+民(min)(min)企(qi)(qi)(qi)”助贷(dai)(dai)模式。推(tui)(tui)广新(xin)型银(yin)担、政(zheng)银(yin)担合(he)作(zuo)(zuo),扩大批(pi)量担保业(ye)务(wu)规(gui)模。推(tui)(tui)动(dong)符(fu)合(he)条(tiao)件的民(min)(min)营(ying)企(qi)(qi)(qi)业(ye)利用可转债(zhai)、科技(ji)(ji)创(chuang)新(xin)债(zhai)券、ABS产(chan)品(pin)等融(rong)(rong)(rong)(rong)资(zi)(zi)。推(tui)(tui)动(dong)符(fu)合(he)条(tiao)件的民(min)(min)间投资(zi)(zi)项(xiang)(xiang)目发行(xing)(xing)基础(chu)设施不动(dong)产(chan)投资(zi)(zi)信(xin)(xin)(xin)托基金(jin)(jin)。用好国家科技(ji)(ji)创(chuang)新(xin)和技(ji)(ji)术(shu)改(gai)造(zao)再贷(dai)(dai)款(kuan)政(zheng)策,激励(li)(li)引(yin)导金(jin)(jin)融(rong)(rong)(rong)(rong)机构加(jia)(jia)大对(dui)(dui)科技(ji)(ji)型中小企(qi)(qi)(qi)业(ye)以(yi)及重(zhong)点领域(yu)技(ji)(ji)术(shu)改(gai)造(zao)和设备更新(xin)项(xiang)(xiang)目的金(jin)(jin)融(rong)(rong)(rong)(rong)支持(chi)力(li)度(du)。深化(hua)企(qi)(qi)(qi)业(ye)上(shang)市(shi)(shi)“一件事”集成(cheng)服(fu)(fu)(fu)务(wu),推(tui)(tui)动(dong)更多民(min)(min)营(ying)企(qi)(qi)(qi)业(ye)上(shang)市(shi)(shi)融(rong)(rong)(rong)(rong)资(zi)(zi)和再融(rong)(rong)(rong)(rong)资(zi)(zi)。发挥(hui)区域(yu)性股权市(shi)(shi)场(chang)作(zuo)(zuo)用,加(jia)(jia)强民(min)(min)营(ying)上(shang)市(shi)(shi)后(hou)备企(qi)(qi)(qi)业(ye)培(pei)育。
(七)完善拖(tuo)(tuo)欠(qian)(qian)账(zhang)(zhang)款(kuan)(kuan)(kuan)常(chang)态(tai)化(hua)预防和清理机(ji)制。严格落实《保障中小企(qi)(qi)业款(kuan)(kuan)(kuan)项支付条(tiao)例(li)(li)》,健(jian)全防范化(hua)解拖(tuo)(tuo)欠(qian)(qian)中小企(qi)(qi)业账(zhang)(zhang)款(kuan)(kuan)(kuan)长效(xiao)机(ji)制。加大(da)拖(tuo)(tuo)欠(qian)(qian)民营企(qi)(qi)业账(zhang)(zhang)款(kuan)(kuan)(kuan)清理力度,重点清理机(ji)关、事业单(dan)位、大(da)型(xing)企(qi)(qi)业拖(tuo)(tuo)欠(qian)(qian)中小微企(qi)(qi)业账(zhang)(zhang)款(kuan)(kuan)(kuan),依(yi)法依(yi)规加大(da)对(dui)相(xiang)关责(ze)任人(ren)的问责(ze)处罚力度。健(jian)全拖(tuo)(tuo)欠(qian)(qian)账(zhang)(zhang)款(kuan)(kuan)(kuan)投诉处理和信用监(jian)督(du)机(ji)制,对(dui)恶(e)意拖(tuo)(tuo)欠(qian)(qian)账(zhang)(zhang)款(kuan)(kuan)(kuan)案例(li)(li)依(yi)法依(yi)规予以曝光(guang)。
(八)强(qiang)(qiang)化(hua)人(ren)才(cai)(cai)(cai)和用工需求保(bao)障。畅(chang)通人(ren)才(cai)(cai)(cai)向民(min)营(ying)(ying)企业(ye)(ye)(ye)流动(dong)渠(qu)道,完善人(ren)事管(guan)理、档案(an)管(guan)理、社(she)会保(bao)障等(deng)接续的政策机(ji)(ji)(ji)制。健全市场化(hua)人(ren)才(cai)(cai)(cai)分类评(ping)价机(ji)(ji)(ji)制,在(zai)民(min)营(ying)(ying)企业(ye)(ye)(ye)中探索实行“以薪定才(cai)(cai)(cai)”制度(du)。支持(chi)(chi)民(min)营(ying)(ying)企业(ye)(ye)(ye)通过协(xie)议(yi)、特(te)聘(pin)、兼职(zhi)(zhi)、技(ji)术(shu)(shu)咨询等(deng)方(fang)式柔性引进高层次(ci)人(ren)才(cai)(cai)(cai)。支持(chi)(chi)民(min)营(ying)(ying)企业(ye)(ye)(ye)建(jian)(jian)设“人(ren)才(cai)(cai)(cai)飞地”,在(zai)省(sheng)(sheng)外(海外)全资(zi)设立的研发机(ji)(ji)(ji)构、省(sheng)(sheng)级备案(an)认定的离岸创(chuang)新创(chuang)业(ye)(ye)(ye)基地全职(zhi)(zhi)聘(pin)用的人(ren)才(cai)(cai)(cai),享受在(zai)豫人(ren)才(cai)(cai)(cai)相关政策。赋(fu)予民(min)营(ying)(ying)企业(ye)(ye)(ye)职(zhi)(zhi)称(cheng)评(ping)审权(quan),允许技(ji)术(shu)(shu)实力较强(qiang)(qiang)的规模(mo)以上民(min)营(ying)(ying)企业(ye)(ye)(ye)单独或联合组(zu)建(jian)(jian)职(zhi)(zhi)称(cheng)评(ping)审委员(yuan)会,开展(zhan)自(zi)主评(ping)审。支持(chi)(chi)民(min)营(ying)(ying)企业(ye)(ye)(ye)开展(zhan)企业(ye)(ye)(ye)职(zhi)(zhi)工新型学徒(tu)制培训、职(zhi)(zhi)工岗位技(ji)能提升培训。加强(qiang)(qiang)灵(ling)活就业(ye)(ye)(ye)和新就业(ye)(ye)(ye)形态劳动(dong)者权(quan)益保(bao)障。
(九)强化用(yong)地(di)(di)(di)(di)供给和用(yong)能保障。深化工(gong)(gong)业(ye)(ye)用(yong)地(di)(di)(di)(di)“标准地(di)(di)(di)(di)+承诺制”出(chu)让(rang)改革(ge),持(chi)续推行(xing)长期租赁、先租后让(rang)、弹性年期出(chu)让(rang)、作价出(chu)资(入股(gu))等供地(di)(di)(di)(di)方式(shi),增加混合(he)产业(ye)(ye)用(yong)地(di)(di)(di)(di)供给。鼓(gu)励民营(ying)(ying)企(qi)业(ye)(ye)利(li)用(yong)自有(you)工(gong)(gong)业(ye)(ye)用(yong)地(di)(di)(di)(di)发展(zhan)新(xin)产业(ye)(ye)新(xin)业(ye)(ye)态,根据相关规划及规定允许增加容积率(lv)的,在(zai)不改变土地(di)(di)(di)(di)用(yong)途前提(ti)下,不增收(shou)土地(di)(di)(di)(di)价款等费用(yong)。探索(suo)实(shi)行(xing)产业(ye)(ye)链供地(di)(di)(di)(di),对产业(ye)(ye)链关联项目(mu)涉及的多宗土地(di)(di)(di)(di)实(shi)行(xing)整(zheng)体(ti)供应。鼓(gu)励工(gong)(gong)业(ye)(ye)企(qi)业(ye)(ye)合(he)理优(you)化调整(zheng)生产时(shi)序错峰用(yong)电,支持(chi)民营(ying)(ying)企(qi)业(ye)(ye)投资建设分布(bu)式(shi)光(guang)伏和分布(bu)式(shi)储能项目(mu),综合(he)降(jiang)低用(yong)电成本。建立新(xin)上项目(mu)能效水(shui)平标杆引(yin)导机制,对符合(he)生态优(you)先、绿色(se)低碳发展(zhan)要求的优(you)质(zhi)重(zhong)点(dian)项目(mu)开辟(pi)绿色(se)通道。
(十)全面推行惠(hui)(hui)(hui)企(qi)(qi)(qi)(qi)政(zheng)(zheng)(zheng)策(ce)免(mian)(mian)(mian)申(shen)即(ji)享(xiang)(xiang)。围绕服务民(min)营中(zhong)小(xiao)微企(qi)(qi)(qi)(qi)业(ye)和个体(ti)工(gong)商(shang)户,精准归集(ji)各(ge)类各(ge)部(bu)门涉企(qi)(qi)(qi)(qi)数(shu)据,完善覆盖(gai)省(sheng)、市、县三级的省(sheng)惠(hui)(hui)(hui)企(qi)(qi)(qi)(qi)政(zheng)(zheng)(zheng)策(ce)免(mian)(mian)(mian)申(shen)即(ji)享(xiang)(xiang)平台,动态更新惠(hui)(hui)(hui)企(qi)(qi)(qi)(qi)政(zheng)(zheng)(zheng)策(ce)文(wen)件和免(mian)(mian)(mian)申(shen)即(ji)享(xiang)(xiang)项目清单,打通预算管理(li)一(yi)体(ti)化、涉企(qi)(qi)(qi)(qi)系统(tong)和省(sheng)惠(hui)(hui)(hui)企(qi)(qi)(qi)(qi)政(zheng)(zheng)(zheng)策(ce)免(mian)(mian)(mian)申(shen)即(ji)享(xiang)(xiang)平台资金(jin)拨付通道(dao),推动涉企(qi)(qi)(qi)(qi)资金(jin)直达快享(xiang)(xiang),将各(ge)地惠(hui)(hui)(hui)企(qi)(qi)(qi)(qi)政(zheng)(zheng)(zheng)策(ce)免(mian)(mian)(mian)申(shen)即(ji)享(xiang)(xiang)推进落实情(qing)况纳(na)入全省(sheng)营商(shang)环境(jing)评价体(ti)系,切实落实惠(hui)(hui)(hui)企(qi)(qi)(qi)(qi)政(zheng)(zheng)(zheng)策(ce)。
三(san)、强化民营经济发(fa)展法治保障
(十一)依(yi)法(fa)(fa)保护民(min)营企业(ye)(ye)产权(quan)和(he)企业(ye)(ye)家权(quan)益。严格区分(fen)经(jing)济纠纷、行政违法(fa)(fa)和(he)刑(xing)事(shi)犯(fan)罪,坚决防止以行政或刑(xing)事(shi)手段干预经(jing)济纠纷,坚决防止将民(min)事(shi)责任(ren)变为(wei)刑(xing)事(shi)责任(ren)。进(jin)一步规范涉(she)产权(quan)强制性措(cuo)施,对(dui)不宜(yi)查(cha)封扣押冻(dong)结的经(jing)营性涉(she)案财物,在(zai)保证(zheng)侦(zhen)查(cha)活动正常进(jin)行的同时,可以允许有关当事(shi)人继续(xu)合(he)理使用,并(bing)采取必要的保值保管措(cuo)施,最大限度减少侦(zhen)查(cha)办案对(dui)正常办公(gong)和(he)合(he)法(fa)(fa)生产经(jing)营的影(ying)响。依(yi)法(fa)(fa)打击拒不执行判决、裁定(ding)违法(fa)(fa)犯(fan)罪行为(wei),提高违法(fa)(fa)失信成本,保障企业(ye)(ye)胜诉权(quan)益及时落(luo)实兑现。持续(xu)开展(zhan)涉(she)企刑(xing)事(shi)“挂案”专项清理行动。
(十(shi)二)构建民营(ying)企业(ye)源(yuan)头(tou)防范和治(zhi)理腐败体制(zhi)机制(zhi)。依法加(jia)大对民营(ying)企业(ye)工作(zuo)人员职(zhi)务(wu)侵占、挪用资(zi)金、受(shou)贿等腐败行(xing)为(wei)的惩处力度。健(jian)全涉(she)案(an)财物(wu)追(zhui)缴(jiao)处置机制(zhi)。深化涉(she)案(an)企业(ye)合规改革,开展民营(ying)企业(ye)“法治(zhi)体检(jian)”活动。充(chong)分(fen)发挥(hui)民营(ying)企业(ye)党(dang)组织作(zuo)用,推动企业(ye)加(jia)强法治(zhi)教育,营(ying)造诚信廉洁的性做爰全过程免费视频,黑巨人与欧美精品一(yi)区,男(nan)女裸(luo)体姓交大片,法国(guo)《性爽》2,婷(ting)婷(ting)色播电影氛(fen)围。
(十三)持续完善知识(shi)产权(quan)(quan)(quan)(quan)(quan)保(bao)护(hu)体(ti)系(xi)。加大对民营企业商标(biao)、专利等知识(shi)产权(quan)(quan)(quan)(quan)(quan)的保(bao)护(hu)力度。全面推行(xing)(xing)知识(shi)产权(quan)(quan)(quan)(quan)(quan)民事(shi)、行(xing)(xing)政和刑事(shi)案件(jian)审判“三合(he)一”工作机制。严格(ge)落实知识(shi)产权(quan)(quan)(quan)(quan)(quan)侵(qin)(qin)权(quan)(quan)(quan)(quan)(quan)惩罚(fa)性(xing)赔(pei)偿(chang)、行(xing)(xing)为(wei)保(bao)全等制度,发布(bu)知识(shi)产权(quan)(quan)(quan)(quan)(quan)侵(qin)(qin)权(quan)(quan)(quan)(quan)(quan)惩罚(fa)性(xing)赔(pei)偿(chang)典型案例。加强(qiang)企业商业秘密保(bao)护(hu)。建立健全知识(shi)产权(quan)(quan)(quan)(quan)(quan)质押融(rong)资风险(xian)(xian)(xian)分担和补偿(chang)机制,鼓(gu)励(li)保(bao)险(xian)(xian)(xian)机构(gou)开展知识(shi)产权(quan)(quan)(quan)(quan)(quan)被侵(qin)(qin)权(quan)(quan)(quan)(quan)(quan)损失保(bao)险(xian)(xian)(xian)、侵(qin)(qin)权(quan)(quan)(quan)(quan)(quan)责任保(bao)险(xian)(xian)(xian)等业务。
(十四)完(wan)善监(jian)管(guan)(guan)执法(fa)体系。全(quan)(quan)(quan)面推行(xing)“双随机、一(yi)公开”监(jian)管(guan)(guan)模(mo)式(shi),合(he)(he)理确(que)定抽查(cha)比(bi)例和检(jian)查(cha)频(pin)次。建立(li)健全(quan)(quan)(quan)跨(kua)部门(men)综(zong)合(he)(he)监(jian)管(guan)(guan)制度。全(quan)(quan)(quan)面推行(xing)包(bao)容审慎(shen)监(jian)管(guan)(guan),依法(fa)依规推行(xing)“首违不罚”“轻微免罚”等制度。对新(xin)技(ji)术、新(xin)产业(ye)、新(xin)业(ye)态、新(xin)模(mo)式(shi)创新(xin)监(jian)管(guan)(guan)模(mo)式(shi),在严守质量和安全(quan)(quan)(quan)底线的前提下留足发展空间。
(十五)健全涉企收费长效(xiao)监(jian)管机制(zhi)。完善政府(fu)定价的涉企收费清单制(zhi)度,进行(xing)常态化(hua)公(gong)示,接(jie)受企业和社会监(jian)督(du)。畅通(tong)涉企违(wei)规(gui)收费投诉举报渠(qu)道,开展(zhan)涉企违(wei)规(gui)收费整(zheng)治,公(gong)开曝光(guang)违(wei)规(gui)收费典(dian)型案例(li)。
四、着力推动民营经济实现高质量发展(zhan)
